What is this for?

This privacy policy meets the legal requirements for transparency in the processing of personal data. This is any information relating to an identified or identifiable natural person. This includes, for example, information such as your name, age, address, telephone number, date of birth, e-mail address, IP address, or user behaviour when visiting a website. Information for which we cannot establish a link to your person, e.g. through anonymization, is not personal data. The processing of personal data (e.g. collection, retrieval, use, storage or transmission) always requires a legal basis and a defined purpose.

Stored personal data is deleted as soon as the purpose of processing has been achieved and there are no legitimate grounds for further retention of the data. We will inform you in the individual processing operations about the specific storage periods or criteria for storage. Irrespective of this, in some cases we store your personal data for the assertion, exercise or defence of legal claims and in the event of statutory retention obligations.

Who receives my data?

We only disclose your personal data that we process on our website to third parties where necessary for the fulfilment of the purposes and as covered by the legal basis in the individual case (e.g. consent or protection of legitimate interests). In addition, we disclose personal data to third parties in some cases if this serves the assertion, exercise or defence of legal claims. Possible recipients may then include, for example, law enforcement agencies, lawyers, auditors, courts, etc.

Provided we use service providers for operating our website who process personal data on our behalf within the scope of a commissioned processing pursuant to Art. Art. 28 GDPR, these may be recipients of your personal data. For more information on the use of processors and web services, please refer to the list of individual processing operations.

Are cookies used?

Cookies are small text files that are sent by us to the browser on your end device when visiting our website and are then stored there. As an alternative to using cookies, information can also be stored in the local storage of your browser. Some functions of our website cannot be offered without the use of cookies or local storage (technically necessary cookies). Other cookies, on the other hand, enable us to perform various analyses, to for example recognize the browser you are using when you visit our website again and to transmit various information to us (non-essential cookies). Cookies allow us, among other things, to make our website more user-friendly and effective for you, for example by tracking your use of our website and determining your preferred settings (e.g. country and language settings). If third parties process information via cookies, they collect the information directly through your browser. Cookies do not harm your device. They cannot execute programs or contain viruses.

We provide information about the respective services for which we use cookies in the individual processing operations. Detailed information on the cookies used can be found in the cookie settings or in the Consent Manager of this website.

What are my rights?

Under the requirements of the statutory provisions of the General Data Protection Regulation (GDPR), you have the following rights as a data subject:

  • Information according to Art. 15 GDPR about the data stored about you in the form of meaningful information about the details of processing and a copy of your data;
  • Correction according to Art. 16 GDPR of incorrect or incomplete data stored by us;
  • Erasure pursuant to Art. 17 GDPR of the data stored by us, insofar as processing is not necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest, or for the assertion, exercise or defence of legal claims;
  • Restriction of processing pursuant to Art. 18 GDPR, insofar as the accuracy of the data is disputed, processing is unlawful, we no longer need the data and you object to their deletion because you need them for the assertion, exercise or defence of legal claims or you have objected to the processing pursuant to Art. 21 GDPR.
  • Data portability pursuant to Art. 20 GDPR, insofar as you have provided us with personal data within the scope of consent pursuant to Art. 6 (1) (a) GDPR or on the basis of a contract pursuant to Art. 6 (1) (b) GDPR and these have been processed by us with the aid of automated processes. You will receive your data in a structured, common and machine-readable format or we will transfer the data directly to another controller where technically feasible.

How exactly is my data processed?

Below you will find information about the individual processing operations, the scope and purpose of data processing, the legal basis, the obligation to provide your data, and the respective storage period. Automated decision-making in individual cases, including profiling, is not used.

Provision of the website

Nature and scope of processing

When you visit and use our website, we collect the personal data your browser automatically transmits to our server. The following information is temporarily stored in a so-called log file:

  • IP address of the requesting computer
  • Date and time visited
  • Name and URL of the file accessed
  • Website from where it is accessed (referrer URL)
  • Browser used and, if applicable, the operating system of your computer, as well as the name of your access provider

Our website is not hosted by us directly, but by a service provider who processes the aforementioned data on our behalf in accordance with Art. 28 GDPR.

Purpose and legal basis

The processing is carried out to safeguard our overriding legitimate interest to display our website and ensure security and stability on the basis of Art. 6 (1) (f) GDPR. The collection of data and storage in log files is mandatory for operating the website. There is no right to object to the processing due to the exception under Art. 21 (1) GDPR. Where further storage of the log files is required by law, processing is based on Art. 6 (1) (c) GDPR. There is no legal or contractual obligation to provide the data, however, visiting our website is not technically possible without providing the data.

Storage period

The aforementioned data is stored for the duration the website is displayed and for technical reasons beyond that for a maximum of 2 hours.

Contact form

Nature and scope of processing

Our website offers the option to contact us using a form. The information collected via required fields (company name, surname and first name of the contact person, e-mail address, message content) is necessary to process the request. In addition, you may voluntarily provide additional information that you believe is necessary to process the contact request.

When using the contact form, your personal data will not be transmitted to third parties.

Purpose and legal basis

The processing of your data by using our contact form is carried out for the purpose of communication and processing your request based on your consent pursuant to Art. 6 (1) (a) GDPR. If your inquiry is related to an existing contractual relationship with us, processing is carried out for the purpose of fulfilling the contract on the basis of Art. 6 (1) (b) GDPR. There is no legal or contractual obligation to provide your data, however your request cannot be processed without providing the information of the required fields. If you do not wish to provide this information, please contact us by other means.

Storage period

We receive the personal data you provide when using the contact form on the basis of your consent and will only use it to process your request. The reason for your request results in different retention or deletion periods for your personal data, which are structured and implemented as part of our deletion concept, e.g. your data related to a contractual relationship is stored for six years from the end of the contractual relationship and subsequently deleted.

Contact by e-mail

Nature and scope of processing

You have the option to send us a message via the e-mail address info(at)prokuehlsole.de. In this case, your e-mail will be received by our service department and forwarded to the relevant department. Data collection is limited to the e-mail address of the e-mail account used by you to contact us as well as to the personal data voluntarily provided by you in the course of contacting us.

Purpose and legal basis

The processing of your data as a result of sending your e-mail is carried out for the purpose of communication and processing of your request for the purpose of (pre-)contract fulfilment on the basis of Art. 6 (1) (b) GDPR.

Storage period

We receive the personal data provided by you in the context of sending the contact e-mail on the basis of your consent, which is then used exclusively for processing your request. The reason for your request results in different retention or deletion periods for your personal data, which are structured and implemented as part of our deletion concept, e.g. your data related to a contractual relationship is stored for six years from the end of the contractual relationship and subsequently deleted.

YouTube Video allows us to integrate content from the platform into our website.

YouTube Video uses cookies and other browser technologies to analyse user behaviour, recognize users and create user profiles. This information is used, among other things, to analyse the activity of the content listened to and to generate reports. If a user is registered with YouTube, LLC, YouTube Video can associate the videos played with the profile.

hCaptcha

Nature and scope of processing

We have integrated components of hCaptcha on our websites. hCaptcha is a service of Intuition Machines, Inc. (IMI) based in the USA and enables us to determine whether a contact request originates from a natural person or is automated by means of a program. This tool shows captchas – small tasks that are easy for humans to solve, but difficult for machines. These captchas help us identify spam.

The hCaptcha tool on principle processes technical information about your use of our website, such as mouse movements, scroll positions, buttons pressed, touch events on touch displays and possibly movements of your device (e.g. if you use our website with a smartphone). hCaptcha further collects the answers to the small tasks that you are asked. This data is processed by hCaptcha exclusively on our behalf to protect our website from bots and spam. Your (non-personal) answers to the small tasks (e.g. recognizing certain objects in pictures) is also used by hCaptcha to train algorithms.

The hCaptcha analysis in "invisible mode" can entirely take place in the background. Website or app visitors are not made aware that such analysis is taking place unless a challenge is displayed to the user. The processing of the data subject's data in the EU is carried out on the legal basis of the Standard Contractual Clauses (SCC).

Purpose and legal basis

The service is used against the background of ensuring the availability of the website, protecting against bots and on the basis of our legitimate interests pursuant to Art. 6 (1) (f) GDPR.
